LawnDominator Terms of Use

These Terms of Use ("Terms") govern your access to and use of LawnDominator, including the website, mobile applications, and related services (collectively, the "Services").

By using the Services, you agree to these Terms.

Eligibility

The Services are intended for users located within the United States.

You must be at least 18 years old or have the permission of a parent or legal guardian to use the Services.

Your Account

You are responsible for:

  • Maintaining the confidentiality of your password
  • Keeping your account information accurate
  • All activity occurring under your account

You agree to notify us promptly of any unauthorized use of your account.

Subscriptions

Certain features require a paid subscription.

Subscriptions may automatically renew until canceled.

Subscriptions purchased through Apple or Google are managed by the applicable app store and are subject to those platforms' billing policies.

Subscriptions purchased through our website are processed by Stripe.

Except where required by law, subscription fees are non-refundable.

Acceptable Use

You agree not to:

  • Violate applicable laws
  • Attempt unauthorized access to the Services
  • Interfere with the operation or security of the Services
  • Upload malware or harmful code
  • Reverse engineer the Services except where permitted by law
  • Use the Services to infringe upon the rights of others

Your Content

You retain ownership of the information, photos, notes, lawn data, and other content you submit to the Services.

You grant LawnDominator a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your content solely for the purpose of operating, maintaining, securing, improving, and providing the Services.

Our Intellectual Property

LawnDominator and all associated software, designs, logos, graphics, trademarks, text, and other content are owned by LawnDominator or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, or create derivative works from our Services.

Availability

We strive to provide reliable Services but do not guarantee uninterrupted, error-free, or continuous availability.

We may modify, suspend, or discontinue any part of the Services at any time.

Lawn Care Recommendations

The Services provide informational tools, calculations, forecasts, and recommendations related to lawn care.

Results depend on numerous factors outside of LawnDominator's control, including weather, climate, soil conditions, irrigation, pests, disease, equipment, product selection, application methods, and user actions.

You are solely responsible for determining whether any recommendation is appropriate for your property and for complying with all product labels and applicable laws.

We make no guarantee that following recommendations provided by the Services will produce any particular outcome.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAWNDOMINATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAWNDOMINATOR, ITS OWNERS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LAWNDOMINATOR DURING THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) US$100.

Termination

We may suspend or terminate your access to the Services if you violate these Terms or misuse the Services.

You may stop using the Services at any time.

Changes to the Services

We may add, remove, modify, or discontinue features at any time without prior notice.

Governing Law

These Terms are governed by the laws of the State of Texas without regard to conflict of law principles.

Any legal action arising from these Terms shall be brought in the state or federal courts located in Williamson County or Travis County, Texas, unless applicable law requires otherwise.

Changes to these Terms

We may revise these Terms from time to time.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
